Terms of Service
Introduction
These Terms of Service (“Terms”) govern your use of SmartStack, operated by Ruen Ventures LLC (“Company,” “we,” “us,” or “our”). By creating an account or using SmartStack (including smartstackbudget.com and smartstackmoney.com), you agree to these Terms.
SmartStack is NOT financial, investment, tax, or legal advice. All budgets, forecasts, Monte Carlo–style outlooks, and insights are estimates and illustrations only. You are solely responsible for your financial decisions.
1. Eligibility
You must be at least 18 years old to use SmartStack. By using the service, you represent that you meet this requirement.
2. Accounts and Subscriptions
- Free and paid plans may be available; features depend on your plan.
- Paid subscriptions are billed via Stripe and auto-renew until you cancel.
- Fees and plan details are shown at checkout. No refunds except as required by law.
- You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account.
3. Plaid and Financial Data
When you choose to connect banks or brokerages, Plaid provides read-only access to account and transaction data. We never receive your bank or brokerage login credentials and cannot move funds. You authorize that connection and are responsible for the accuracy of linked data as provided by Plaid and your institutions.
4. Intellectual Property
- We own SmartStack software, design, branding, and features.
- You retain ownership of the budgets, goals, notes, and other content you create.
- You grant us a limited license to host, display, process, and back up your content solely to operate and improve the service.
5. Prohibited Conduct
You agree not to:
- Misuse the service, attempt unauthorized access, or disrupt systems or other users.
- Upload malware, scrape at abusive scale, or reverse engineer the product except where allowed by law.
- Use SmartStack for unlawful purposes or to violate others’ rights.
- Share false information to circumvent plan limits or payment systems.
6. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.
We are not liable for financial losses, investment outcomes, or decisions you make based on SmartStack data, estimates, or insights.
To the fullest extent permitted by law, our maximum aggregate liability arising out of or related to the service is limited to the greater of (a) one hundred U.S. dollars (US $100) or (b) the fees you paid to us for SmartStack in the twelve (12) months before the claim.
7. Termination
We may suspend or terminate access for violations of these Terms or to protect the service and users. You may cancel a paid subscription at any time through the billing tools we provide (or Stripe customer portal where applicable). Provisions that by nature should survive (including IP, disclaimers, liability limits, and dispute resolution) will survive termination.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
Except where prohibited by law, any dispute arising out of or relating to these Terms or SmartStack will be resolved by binding individual arbitration in Austin, Texas. You and we waive any right to a jury trial and to participate in a class or representative action, to the fullest extent permitted by law.
9. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, are the complete agreement between you and Ruen Ventures LLC regarding SmartStack and supersede prior agreements on the same subject. We may update these Terms by posting a new effective date in the app; continued use after an update constitutes acceptance where permitted by law.
